NKV Fashion operates this website and provides its related information, features, products, customer-support facilities and purchasing services (together, the “Services”). The website is hosted using Shopify’s commerce platform.

These Terms apply whenever you visit or use the Services. Our Privacy Policy, Refund Policy, Shipping Policy, product-page disclosures and any promotion-specific terms are incorporated into these Terms by reference.

If you do not agree to these Terms, please do not use the Services or place an order. Nothing in these Terms excludes or restricts any right or remedy that cannot lawfully be excluded under applicable consumer-protection law.

You must be at least 18 years old and legally competent to enter into a contract under applicable Indian law to place an order. A parent or lawful guardian must supervise and take responsibility for any use involving a minor.

You agree to provide accurate, current and complete information during account creation and checkout. You are responsible for keeping account credentials confidential and for activity conducted through your account. Notify us promptly if you suspect unauthorised access.

You may not transfer, sell or assign your account. We may request reasonable verification, restrict access or suspend an account when needed to protect customers, prevent fraud, comply with law or enforce these Terms.

We make reasonable efforts to describe products accurately, including their material, design, dimensions, size, colour and included components. Please read the relevant product page and size information before ordering.

Actual colours, shine, texture or detailing may appear slightly different because of photography, lighting, screen calibration, device settings and natural production variation. This does not affect any remedy available where a product is materially misdescribed, defective or otherwise fails to meet a mandatory legal standard.

Products and variants are subject to availability. We may introduce, modify, limit or discontinue products, but changes will not reduce rights relating to an order already accepted by us.

Unless stated otherwise, prices are displayed in Indian Rupees (INR). The product price, applicable tax, shipping charge, discount and final payable total presented at checkout govern that order, subject to correction of a genuine and obvious error before acceptance.

Promotions, coupon codes and sale offers may have separate eligibility, duration, product, quantity or combination restrictions. They may be modified or withdrawn prospectively. Unless expressly stated, offers cannot be combined.

You confirm that you are authorised to use the selected payment method and that the payment and billing information supplied is accurate. Payments may be processed by third-party payment providers under their own terms. Cash on Delivery, if displayed, may be subject to serviceability and verification.

Submitting an order is your offer to purchase the selected products. An automated order acknowledgement confirms receipt but does not by itself mean that we have accepted the order. Acceptance occurs when we expressly confirm acceptance, dispatch the order or otherwise begin fulfilment.

Before acceptance, we may verify contact, address, payment, product availability and order details. We may reject or cancel an order for a genuine reason including non-availability, payment failure, suspected fraud, inaccurate information, serviceability restrictions, quantity or resale concerns, or an obvious pricing or listing error.

If we cancel a prepaid order before fulfilment, the amount collected for the cancelled portion will be returned through the appropriate payment method, subject to normal banking or payment-provider processing times.

Customer requests to change or cancel an order should be made promptly through our Contact Us page. We will try to assist, but a change or cancellation may not be possible after processing or dispatch has begun. Any applicable cancellation treatment will comply with law and the policy disclosed for the order.

Processing, dispatch, tracking, delivery estimates, serviceability, shipping charges, failed delivery and return-to-origin matters are governed by our Shipping Policy.

You are responsible for providing a complete delivery address, correct postal code and reachable contact number. Contact us immediately if you notice an error. Address changes may not be possible after dispatch.

Delivery dates are estimates unless we expressly provide a guaranteed commitment. We will make reasonable efforts to support delayed or disrupted shipments. Risk of loss ordinarily passes upon delivery to you or an authorised recipient, subject always to applicable law and the circumstances of the delivery.

Eligibility, request periods, condition requirements, exclusions, evidence, return instructions, inspection and refund processing are governed by the Refund Policy displayed on the website when your order is placed, together with mandatory consumer rights.

Please inspect the parcel promptly after delivery. For a damaged, defective, missing or incorrect item, contact us within the applicable policy period with the order number and requested supporting material. Do not send an item back until return instructions have been provided.

A refund approved by us will be initiated using the method stated in the Refund Policy. Banks, card networks and payment providers may require additional time to credit the amount after initiation.

Unless we agree otherwise in writing, products are offered for personal or household use and not for unauthorised commercial resale, export or distribution.

You must use the Services only for lawful purposes. You must not:

• violate any applicable law or the rights of another person;
• submit false, misleading, fraudulent or impersonated information;
• introduce malware, harmful code or automated activity that disrupts the Services;
• scrape, harvest or collect data without lawful authority and our written permission;
• circumvent security, access controls, purchase limits or fraud-prevention measures;
• use the Services to harass, defame, threaten, spam or distribute unlawful material; or
• copy, resell or exploit any part of the Services contrary to these Terms.

The website and its original text, photographs, graphics, videos, logos, product presentation, design, arrangement, software elements and other content are owned by or licensed to NKV Fashion and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive and non-transferable permission to access and use the website for personal shopping and lawful informational purposes. No ownership right is transferred to you.

You may not reproduce, republish, modify, distribute, commercially exploit, frame or create derivative works from protected content without prior written permission, except where the law expressly permits it.

If you voluntarily submit a review, photograph, suggestion, comment or other content (“Submission”), you confirm that it is accurate, lawful, your own content or content you are authorised to provide, and does not infringe another person’s rights.

You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, display and use the Submission for operating, improving and promoting the Services, subject to our Privacy Policy and applicable law. This licence does not transfer your ownership of the Submission.

We may moderate or remove a Submission that is unlawful, misleading, abusive, irrelevant, infringing, contains personal information that should not be public, or otherwise violates these Terms. We are not required to publish every Submission.

The website is powered by Shopify, which supplies technology used to deliver the online storefront. Your purchase contract is with NKV Fashion, not Shopify.

The Services may use or link to third-party services such as payment gateways, courier tracking, social platforms or external websites. Their services may be governed by separate terms and privacy notices. We do not control an independent third party’s website or service and are not responsible for its separate acts or content, except to the extent liability cannot lawfully be excluded.

Please review third-party terms before using an optional external service. A link does not necessarily mean that we endorse all content on the linked website.

Our collection, use, disclosure and protection of personal information are described in the Privacy Policy. Please read it before creating an account or placing an order.

We may process information needed to provide the Services, complete transactions, prevent fraud, provide support and meet legal obligations. Shopify, payment providers, couriers and other service providers may process relevant information for these purposes, including from locations outside your state or country where permitted by law.

If these Terms conflict with the Privacy Policy on a matter concerning personal-data processing, the Privacy Policy will control for that matter, subject to applicable law.

Despite reasonable care, the website may occasionally contain typographical errors, outdated information, omissions or technical issues involving product descriptions, availability, pricing, promotions, shipping or other content.

We may correct information and update the Services. If a material error affects an order before acceptance, we may contact you with the correct information and provide an appropriate option, including cancellation and refund of any amount collected where applicable.

We may perform maintenance or change website functionality. We do not promise uninterrupted or error-free access, but this clause does not limit obligations that apply to an accepted order or any non-waivable statutory right.

You may stop using the Services at any time. We may restrict, suspend or terminate access where we reasonably believe there is fraud, unlawful conduct, material breach of these Terms, misuse of the website or a security risk.

Termination does not affect rights and obligations accrued before termination, including payment obligations, accepted orders, refunds or remedies. Provisions that by their nature should continue—including intellectual property, liability, indemnity, dispute and governing-law provisions—will survive.

Consumer-rights safeguard: Nothing in this section excludes liability, a guarantee, a remedy or another right that cannot be excluded or limited under the Consumer Protection Act, 2019 or other applicable law.

To the fullest extent permitted by law, the website and general informational content are provided on an “as available” basis. We do not warrant that website access will always be uninterrupted, secure or free from every technical error.

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special or consequential loss that was not reasonably foreseeable and did not arise directly from our breach. Where liability may lawfully be limited, our aggregate liability relating to a product will not exceed the amount paid for that product.

This limitation does not apply to fraud, wilful misconduct, personal injury caused by negligence, breach of a mandatory consumer guarantee, or any liability that applicable law prohibits us from limiting.

To the extent permitted by law, you agree to indemnify NKV Fashion against third-party claims and reasonable losses directly resulting from your unlawful misuse of the Services, infringement of another person’s rights, or material breach of these Terms. This does not require you to indemnify us for our own negligence, breach or unlawful conduct.

Neither party will be responsible for delay or failure caused by an event beyond its reasonable control, such as natural disaster, severe weather, epidemic, war, civil disturbance, strike, government restriction, network failure or widespread logistics disruption. The affected party must take reasonable steps to reduce the effect and resume performance.

If such an event materially prevents fulfilment for an extended period, we will communicate available options consistent with applicable law, which may include cancellation and an appropriate refund for an unfulfilled prepaid order.

Your rights under the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020 and other applicable laws remain available to you.

For an order, product, payment, delivery, return or website grievance, contact us at nkv.com93@gmail.com with the subject “Grievance” and include your name, order number, registered contact information and a clear description of the issue.

We aim to acknowledge a consumer grievance within 48 hours and resolve it within one month from receipt, in accordance with applicable law. A complex matter, banking delay, courier investigation or need for further information may affect the practical resolution time, but we will keep you reasonably informed.

Nothing in these Terms prevents you from approaching a competent consumer commission, regulator, statutory authority or other forum available under law.

These terms of Service and any separate agreements whereby we provide you services shall be governed by and constructed in accordance with the law of India

If a dispute arises, please contact us first so that both parties can attempt a good-faith resolution. If the dispute is not resolved, it may be brought before a court, consumer commission or other competent forum having jurisdiction under Indian law.

Subject to mandatory consumer jurisdiction and any other non-waivable statutory right, courts and competent forums at Surat, Gujarat, India will have jurisdiction over disputes connected with these Terms or the Services.

We may update these Terms by posting a revised version on this page and changing the “Last updated” date. Material changes will apply prospectively from the stated effective date unless applicable law requires otherwise. An accepted order will ordinarily remain governed by the terms disclosed when that order was accepted.

If a provision is held unlawful or unenforceable, it will be limited or severed only to the minimum extent necessary, and the remaining provisions will continue in effect. Failure to enforce a provision on one occasion is not a waiver of it.

These Terms and the policies incorporated by reference form the entire agreement concerning your use of the Services and supersede earlier communications on the same subject. Headings are included for convenience and do not change the meaning of a provision.

You may not assign your rights or obligations under these Terms without our written consent. We may assign them as part of a lawful business transfer, restructuring or service arrangement, provided this does not reduce your mandatory rights.
